Oklahoma Closing Costs for Sellers in 2026: Transfer Tax, Fees and Real Numbers
Oklahoma's documentary stamp tax on deeds is 75 cents per $500 paid by buyer or seller. See the math on a $300,000 sale and what it means for flips.
Oklahoma charges a documentary stamp tax on deeds of 75 cents for each $500 of consideration, or fractional part. Oklahoma Tax Commission rules say it may be paid by either the grantee or the grantor, so your contract decides. On a hypothetical $300,000 sale the tax is $450.
Oklahoma’s seller cost is a stamp tax, and the payer is negotiable
Oklahoma does not have a state transfer tax by that name. It has a documentary stamp tax on deeds, collected by the county clerk when the deed is recorded. What makes Oklahoma different from most states in this series is that the rules do not name one side as the payer.
Everything below comes from the Oklahoma Tax Commission’s Chapter 30 rules, read in October 2026.
The rate
| Item | What the rules say |
|---|---|
| Rate | 75 cents for each $500, or fractional part, of consideration (OAC 710:30-1-10) |
| Who pays | Either the grantee or the grantor (OAC 710:30-1-8) |
| How it is paid | Stamps are affixed to the deed at the county clerk when the deed is offered for recording |
| Consideration | Money or other value exchanged or to be exchanged, including any assumed indebtedness |
The rules include a sample: a $30,250 sale needs 61 stamps at 75 cents each, or $45.75. The tax is computed in whole 75-cent units, with no rounding down. Exempt transfers exist, and the clerk may ask for documentation if no exemption reason is noted on the deed.
Worked example: a hypothetical $300,000 sale
| Line | Math | Amount |
|---|---|---|
| Documentary stamp tax | $300,000 / $500 = 600 units x $0.75 | $450 |
That is $450 on the whole sale, not per party.
Documentary stamp tax at 75 cents per $500
| Sale price | Units of $500 | Stamp tax |
|---|---|---|
| $150,000 | 300 | $225 |
| $300,000 | 600 | $450 |
| $500,000 | 1,000 | $750 |
Remember that the statute allows either party to pay. The same $450 on a $300,000 sale can be a seller cost, a buyer cost or a split, depending on your contract, so write the answer into the offer.
Who customarily pays
Oklahoma’s rule does not choose a payer, so this is a contract term. Some deals have the seller buy the stamps, some have the buyer, and some split the cost. We did not find a source that states a single statewide custom, so ask your title company what is customary in your county before you write the offer. Agent commission is negotiable.
Other seller costs to expect
- Agent commission. Negotiable.
- Mortgage payoff. Your balance plus interest through the payoff date.
- Property tax proration. Settled at closing; your title company will show how.
- Title and settlement charges. Get a quote early. We did not find a sourced premium rule or statewide custom, so none is quoted here.
What this means for investors
Because either side can pay, the first question on any Oklahoma deal is who buys the stamps. On a flip the tax can appear on both your purchase and your resale. At $200,000 in and $300,000 out, the stamp tax is 400 x $0.75 = $300 on the first deed and $450 on the second. If your contract assigns the cost to you in both, the total is $750.
Wholesale structure changes the count. An assignment generally produces one closing, so stamps are calculated on the one deed to your end buyer. A double close means two closings and two sets of costs: buy at $200,000 and resell at $230,000, and the stamps are $300 on the first deed and 460 x $0.75 = $345 on the second. The rules also say assumed and wraparound mortgages are taxed on the mortgage balance plus other consideration, which matters if you structure with seller financing. Have your title company price it before you quote a wholesale fee.
Add it to the max allowable offer. If you expect to pay the stamps at resale, subtract that amount with repairs, holding costs and profit. If the buyer pays, note that in the contract so your math matches the paper.

Common questions
How much is the Oklahoma documentary stamp tax on a home sale?
Oklahoma Tax Commission rule 710:30-1-10 says stamps worth 75 cents must be affixed for each $500, or fractional part, of the consideration. That is 0.15% of the price. On a $300,000 sale, 600 units at 75 cents is $450. The county clerk collects it when the deed is offered for recording.
Who pays the documentary stamp tax in Oklahoma, the buyer or the seller?
Oklahoma Tax Commission rule 710:30-1-8 says property transferred by deed that is not specifically exempted is subject to the tax and shall be paid by either the grantee or the grantor. The law does not fix one side, so the purchase contract and local custom decide. Ask your title company what is customary.
What counts as consideration for Oklahoma documentary stamps?
The Tax Commission defines consideration as the actual pecuniary value exchanged or paid, or to be paid in the future, in money or otherwise, including any assumed indebtedness. The rules also say assumed or wraparound mortgages are taxed on the mortgage balance plus other valuable consideration exchanged.
